Terms and Conditions and Privacy Policy of Get Ride adopted on 25/05/2018

1. General provisions.

The following Terms and Conditions of Get Ride Spółka Cywilna, based in Szczecin, ul. Cyfrowa 6, 71-441 Szczecin, holding a Tax ID No. 851-317-18-86, whose partners are Wojciech Pelczyk, holding a Tax ID No. 852-229-15-03 and Kamil Martyniuk, holding a Tax ID No. 537-230-32-48 (hereinafter referred to as Get Ride) specify the transport service offered to the User, i.e. a natural person, a legal entity or an organizational unit without legal personality, which the Law grants legal capacity, making an Order on its behalf or on its and the Passengers behalf, hereinafter referred to as the Service.

1.1. Get Ride and the User may be bound by the Individual Customer Cooperation Agreement, Business Client Cooperation Agreement or VIP Client Cooperation Agreement. In such case, the provisions of the Terms and Conditions shall apply only to subject matters not regulated in the Cooperation Agreement.

1.2. The service is offered in three classifications (price categories):

1.2.1. Get Ride - More than Taxi, hereinafter referred to as MTT

1.2.2. Get Ride – VAN, hereinafter referred to as VGR

1.2.3. Get Ride – Business, hereinafter referred to as BGR

1.3. The service is provided under the following variations:

1.3.1. Transferring the User using the Get Ride car with the driver from the place of pick-up specified by the User to a specific destination, hereinafter referred to as the Transfer;

1.3.2. Renting a vehicle with a driver for a specific time (hereinafter as Time Reservation);

1.3.3. Individual Order, personally set by the User with Get Ride.

2. How an Agreement is Concluded.

2.1. An agreement between Get Ride and the User can be generated in two ways:

2.1.1. An Agreement - Commission, in case of delayed payment.

2.1.2. An Agreement - Confirmation of Reservation, after Get Ride confirms payment, and where the User is required to sign the confirmation before the Service is performed.

2.2. The User can order a Service via:

2.2.1. The website available at www.getride.pl;

2.2.2. The helpline at +48 501 527 526;

2.2.3. Email: booking@getride.pl

2.2.4. To order a Service via the website, it is necessary to enter www.getride.pl and fill in the reservation form.

2.2.5. In the form, the User is obliged to provide the following data:

● Place of departure

● Place of arrival

● Date and time of departure

● Type of vehicle with a price option

● Specify whether it is both ways or not

● Name of registering person

● Street and flat number of the location of departure

● ZIP code of the place of departure

● City of departure

● Data and time of return

● E-mail address

● Phone number

● Additional requests

● Additional invoice data (optional):

» Name of company

» Street and flat number of location

» ZIP code and city

» Tax ID No.

The User is obliged to take further technical steps following the message boards and information displayed on the website. Next, unless the Cooperation Agreement provides otherwise, the User is obliged to make the payment in accordance with the provisions contained in Chapter 3 of the Terms and Conditions. After making the payment, the User shall receive (to the e-mail address provided in the form) the Agreement which also serves as the confirmation of the reservation and the VAT invoice for the services ordered.

2.2.6. To order the service via a helpline, please call +48 501 527 526 and, after connecting to the helpline employee, select the right Service and then provide the helpline with the data specified in the preceding clause. After providing all the data, the User will receive a link to the payment form, along with the Commission Agreement, to his or her e-mail address.

2.2.7. Ordering a Service under the Cooperation Agreement is based on the provisions described in the relevant Cooperation Agreement: Individual Client, Business Client, VIP Client.

2.2.8. The Agreement between Get Ride and the User is concluded when the User receives the Agreement which also serves as the confirmation of the reservation.

2.2.9. The Agreement, which also serves as the confirmation of the reservation, contains the following data:

● Place of departure

● Place of arrival

● Date and time of departure

● Type of vehicle with a price option

● Specify whether it is both ways or not

● Name of registering person

● Street and flat number of the location of departure

● ZIP code of the place of departure

● City of departure

● Data and time of return

● E-mail address

● Phone number

● Additional requests

● Additional invoice data (optional):

» Name of company

» Street and flat number of location

» ZIP code and city

» Tax ID No.

2.2.10. The User can place an order in Get Ride only if he or she provides correct and complete information about the User or the person authorized to act on behalf of the User. Using an automated ordering system is prohibited.

2.2.11. Each time the User places a Service Order via the website www.getride.pl, it is equivalent to accepting the Terms and Conditions.

2.2.12. Individual Orders can only be placed via the helpline or e-mail: booking@getride.pl. After providing all the data, the User will receive a link to the payment form, unless the Cooperation Agreement provides otherwise, to his or her e-mail address. After making the payment, the User shall receive the Agreement which also serves as the confirmation of the reservation, to his or her e-mail address. The VAT invoice is issued after the order is completed and is sent to the email address provided in the Reservation Agreement.

3. Price for Service and Payment Options.

3.1. The final price for the Service is given in the Agreement confirming the reservation or the Agreement - Commission.

3.2. In Get Ride, the service price includes the transport service fee, the driver's remuneration, and all applicable taxes.

3.3. The price depends on: the selected vehicle classification, route, reservation date, pick-up place and additional options specified in the additional services price list in Chapter 21 of the Terms and Regulations.

3.4. In the case of Transfer, the Price per Service is determined based on the Order. For each stop, an Additional Fee may be charged, in accordance with the provisions in Chapter 4 of the Terms and Conditions. Additional Fees may arise for any changes to the provisions in the Order for the specific type of transport.

3.5. Get Ride reserves the right to change the terms and conditions of transport after the conclusion of the agreement. In case of events described in Chapter 12.

3.6. In the case of Time Reservations, the price is calculated based on the duration of the Service declared by the User, including the set mileage limit.

3.7. In the case of Individual Orders, the Price is determined by a personal agreement between the User and Get Ride.

3.8. Payments can be made as follows:

3.8.1. Credit card transactions and e-transfers are carried out via Dotpay.pl

3.8.2. By bank transfer to the account number available in the Agreement - Confirmation of Reservation or Agreement - Commission.

3.9. To pay for the ordered services, the User has 72 hours before the time specified as the date and time of travel in the Agreement - Commission.

4. Extra Fees.

4.1. An extra Transfer fee is not charged for waiting at mass transit service points, such as airports, train stations, bus stations, ferry terminals, etc.:

4.1.1. Up to 90 minutes after the scheduled pick-up time, in the event of a delay of a means of transport such as an airplane, train, bus, ferry, etc., which in turn led to a shift of the original pick-up time.

4.1.2. Up to 45 minutes in any other situation.

4.2. For places not specified in point 4.1., the maximum waiting time is 15 minutes, and each subsequent waiting minute is to be calculated to the Extra Fee corresponding to the Service Price for a given classification of vehicle, in accordance with the Price List.

4.3. For going over the mileage limit in the case of Time Reservation, an Extra Fee is included in accordance with the price list for additional services.

4.4. Additional requests from the User, such as a driver with knowledge of several foreign languages, specific markings on the vehicle, stopovers, and car seats for transporting children may result in charging extra fees.

4.5. Get Ride may charge an extra fee for transporting animals.

4.6. When paying by credit card, the handling fees due to the card's operator shall be covered by Get Ride.

4.7. Other transfer-related payments (e.g. when paying in a foreign currency) are covered by the User.

4.8. Get Ride charges a fee for issuing a payment reminder letter. In the event of making a reservation payment with an invalid credit card, Get Ride charges the User for the costs and expenses incurred to other institutions (bank, credit institution, current payment system operator) and reserves the right to claim while charging handling fees each time.

5. Classification and Models of Cars.

5.1. While placing an Order, the User may choose a car from the following vehicle classifications: MTT, VGR, and BGR.

5.1.1. For MTT, the Service is provided with the following vehicles: notably Passat CC, BMW 5 Series or a car of the same classification.

5.1.2. For VGR, the Service is provided with the following vehicles: Mercedes Viano or a car of the same classification.

5.1.3. For BGR, the Service is provided with the following vehicles: notably BMW 7 Series or a car of the same classification.

5.2. Get Ride states that the photos of vehicles presented on the website www.getride.pl serve as examples and cannot be the basis for any claims on the part of the User.

5.3. Depending on the availability of a specific car classification, the User can change from MTT to VGR or BGR, which will result in an extra fee in accordance with the price list.

5.4. The maximum number of passengers and luggage per vehicle is an estimate, depending on factors such as the size and weight of passengers and luggage. The data cannot be the basis for any claims against Get Ride.

6. Terms of Service.

6.1. If the User plans to transport animals, he or she is obliged to provide this information during the process described in Chapter 2 of the Terms and Conditions.

6.2. Get Ride may refuse to take additional pieces of luggage or an animal if the User failed to provide such information during reservation. Refusal may also apply to situations where animals are not placed in closed cages/containers adapted to their transport. In this position, Get Ride retains the right to charge the full Price for the Service.

6.3. Get Ride has the right to refuse transport of people or goods if, in its opinion, the safety conditions/size of the vehicle do not allow it.

7. Transport of Children.

7.1. During reservation, the User is obliged to specify the number of children transported in order for Get Ride to install the required vehicle equipment.

7.2. If the User fails to provide information about transporting children or provides incorrect information, Get Ride reserves the right not to provide the Service without retaining the right to charge the Price for the Service.

8. Force Majeure.

8.1. In the event of a force majeure, notably air traffic controllers' strike or extremely bad weather conditions, it is possible to withdraw from charging extra fees for the waiting time referred to in Chapter 4 of the Terms and Conditions or cancel the Order free of charge.

9. Cancelling an Order.

9.1. Transfer: the Order can be cancelled free of charge if the car is not yet on its way to the pick-up place or cancellation occurs at least six hours before the agreed time of pick-up. Otherwise, the User is obliged to pay the full Price. If the Order is cancelled less than 24 hours before the agreed time of pick-up, notification is possible only by phone.

9.2. Time Reservation: the Order can be cancelled free of charge no later than 24 hours before the scheduled pick-up time. If the Order is cancelled later than 24 hours, but not earlier than 6 hours before the agreed time of pick-up, the Get Ride fee is 50% off, provided that the car is not yet on its way to the place of pick-up. If the Order is cancelled less than 1 hour before the time of pick-up or when the driver is already on its way to the place of pick-up, the Get Ride fee is due in full. If the Order is cancelled less than 48 hours before the agreed pick-up, notification is possible only by phone.

10. Failure to Take Transport by the User.

10.1. Transfer:

10.1.1. The transport shall be deemed as not taken if the User did not cancel the Order and did not appear at the agreed pick-up place within 30 minutes after the agreed time of pick-up. Transport not taken is subject to the full Price, excluding the Extra Fee for a 30-minute waiting period subject to the following points:

10.1.1.1. In the event of pick-up at mass transit service points, such as airports, train stations, bus stations, ferry terminals, etc., the transport shall be deemed as not taken if the User did not cancel the Order and did not appear at the agreed pick-up place within 60 minutes after the agreed time of pick-up, in the event of a delay of a means of transport such as an airplane, train, bus, ferry, etc., which in turn led to a shift of the original pick-up time. Transport not taken is subject to the full Price, excluding the Extra Fee for a 90-minute waiting period.

10.1.1.2. The exception is a situation when the User and Get Ride agree on a later pick-up time on the phone. Possible Extra Fees for waiting times are in accordance with the provisions described in Chapter 4 of the Terms and Conditions.

10.2. Time Reservation:

10.2.1. Time Reservation shall be deemed as not taken if the User did not cancel the Order and did not appear at the agreed pick-up place within 30 minutes after the agreed time of pick-up. The full Price is charged for Time Reservation not taken, subject to the following points:

10.2.1.1. In the event of pick-up at mass transit service points, such as airports, train stations, bus stations, ferry terminals, etc., the Time Reservation shall be deemed as not taken if the User did not cancel the Order and did not appear at the agreed pick-up place within 90 minutes after the agreed time of pick-up, in the event of a delay of a means of transport such as an airplane, train, bus, ferry, etc., which in turn led to a shift of the original pick-up time. Transport not taken is subject to the full Price.

10.2.1.2. The exception is a situation when the User and Get Ride agree on a later pick-up time on the phone. In this case, the Client shall receive the updated Confirmation of Reservation. The time of Service is then determined in accordance with the last Confirmation of Reservation sent. Any extension of the reservation period includes an Extra Fee according to the provisions specified in Chapter 4 of the Terms and Conditions.

11. User's/Passenger's Behaviour during the Service.

11.1. During the Transfer/Time Reservation/Individual Order, all Users/Passengers are subject to general road safety regulations, notably the obligation to fasten seat belts.

11.2. The total cost of fines for not fastening the passenger's seat belt is covered by the passenger.

11.3. It is required to follow the instructions of the persons acting on behalf of Get Ride.

11.4. In particular, you are not allowed to: open the vehicle door while driving, throw objects out of the vehicle and/or expose any body parts out of the vehicle, and shouting.

11.5. Using devices available in the vehicle by the User/Passenger is allowed only after prior advice given by the person acting on behalf of Get Ride.

11.6. Smoking inside the car is not allowed. If the User/Passenger ignores the smoking ban, he or she will bear the costs of cleaning the vehicle and the costs connected with the vehicle being temporarily out of commission.

11.7. Bringing food inside the vehicle is not welcome. Alcoholic beverages can be brought and consumed in the vehicle, after prior arrangement with the person acting on behalf of Get Ride.

11.8. If the User/Passenger breaks any of the provisions contained in this Chapter, Get Ride reserves the right to terminate the Service with the right to charge the full Price and extra fees for any damage caused by the User.

11.9. In case of a situation provided for in clause 11.8. Get Ride is not responsible for any damage incurred by the User/Passenger.

11.10. The User/Passenger is responsible for any damage caused by himself or herself or the persons for whom he or she is responsible as well as by the animals and luggage carried by him or her, to Get Ride during the Service.

12. Change of Terms of Service.

12.1. All Order Changes, made after receiving the Confirmation of Agreement - confirmation of the reservation can be reported by phone. The rules on cancellation of the original Order are governed by the provisions of Chapter 9.

12.2. After receiving the Agreement confirming the Reservation, and even during the Service (if the person acting on behalf of Get Ride allows it), the User may change the terms of Service.

12.3. For Transfer, in the event of a spontaneous change and extension of the Service by the User (route or time of the Service), a new Price will be calculated, according to the Price List, after the Service, under the provision that the Price will be calculated as for Time Reservation from the Transfer start time.

12.4. For Time Reservation, in the event of a spontaneous change and extension of the Service by the User, a new Price will be calculated, according to the Price List, after the Service, which is settled in "half-hour" measures, i.e. each started minute is rounded to 0.5 hours.

12.5. If the User requests to shorten the Transfer route or shorten the time of the Time Reservation compared to the arrangements contained in the Confirmation, the previously agreed Price is not subject to change.

13. Liabilities.

13.1. Get Ride is not responsible for the accuracy, reliability, completeness, and validity of the offer available at www.getride.pl and for any damages resulting from it, unless they are a result of wilful misconduct or gross negligence. This applies to all types of damages, especially damages caused by errors, delays or interruptions in transmission, problems related to technical equipment or improper operation, loss or deletion of data, viruses or other types of improper use of the website. In addition, Get Ride is not responsible for the availability and viability of features offered at www.getride.pl. The true and full information and content can be found in the Confirmation of Reservation.

13.2. Get Ride is not responsible for any interruptions in access to the website, especially in cases of force majeure, in the event of a failure of communication networks or as a result of events for which Get Ride is not responsible.

13.3. Get Ride is not responsible for the actions of third parties who violate the policy at www.getride.pl or the provisions of the following Terms and Conditions.

13.4. Get Ride reserves the right to change how the website works, in order to make improvements. Therefore, Get Ride can temporarily disable the website without informing the user about this fact beforehand.

13.5. Get Ride reserves the right to refuse Service to persons who violate the provisions of the Terms and Conditions, Cooperation Agreements or otherwise act to the detriment of Get Ride.

14. Copyrights

14.1. All content presented at www.getride.pl is protected under the Act of February 4, 1994 on copyright and related rights, as well as other acts of generally applicable, national and international law.

14.2. Get Ride gives the User access to the website www.getride.pl to use it as intended, in accordance with the provisions of the Terms and Conditions. Using the website in a way that violates the basic rules of the Terms and Conditions (edits, copying, reproduction, transfers, distribution, presentations and other inappropriate purposes) is prohibited.

15. Personal Data Protection and Privacy Policy.

Who is your Personal Data Controller?

The Data Controller, or the entity deciding how your personal data will be used, is Get Ride Wojciech Pelczyk, Kamil Martyniuk s.c., or Get Ride s.c. in short, based in Szczecin at ul. Cyfrowa 6 (hereinafter as "We", "Controller" or "Company").

How do we obtain your Personal Data?

We have received it from you after you signed up at www.getride.pl to order a transport service through the reservation form.

What is the purpose and legal basis for the processing of your personal data by Get Ride s.c.?

We process your personal data because:

· - we send you a free newsletter with information about special offers, promotions, news in our company

· - we need your personal data to complete the service you have ordered

· - we are looking into the application that you directed to us (e.g. via the contact form)

· - we are getting in touch with you, also for the purposes of our services.

We also process your personal data for the purposes outlined below, based on the legitimate interest of the company, meaning to:

· - monitor your activity and the activity of all other users;

· - match our offers in accordance with your previously viewed content;

  • - prepare marketing measure for you;

· - contact you, also for the purposes of any marketing activities, through available communication channels, in particular and with your consent - by e-mail and phone;

  • - provide security;

· - conduct research and analysis on our websites, e.g. to check the effectiveness of individual offers;

  • - conduct statistical analysis.


If you consent to it, we can process your personal data to:

· - save data in cookies, collect data from websites.

· - organize sales, in which you can take part.

You can withdraw your consent to the processing of your personal data at any time, the same way you have expressed it. We process you personal data as long as you do not withdraw your consent.

The fastest way to remove your e-mail from the database is by clicking the "unsubscribe" link in the footer of each e-mail. You can update your personal data using the "update" button, which is located in the footer of every e-mail.

Do You have to provide your Personal Data?

In order to be able to conclude and execute an agreement with you, we require that you provide the following personal data:

  • - Names of passengers
  • - Name of ordering party
  • - Pick-up address, destination address
  • - Phone number
  • - E-mail address
  • - Flight number
  • - Name of company

· - Invoice information (name of company, address, Tax ID No.)

  • - Number of people
  • - Payment method

If, for some reason, you do not provide this personal data, unfortunately, we will not be able to conclude an agreement with you and, consequently, complete your order.

You are required to provide your name and e-mail address so that we can send you confirmation of the order and invoice for the service.

We may need you to provide other necessary personal data if the law requires it. Apart from these cases, providing your personal data is voluntary.

What are your rights over the Company in terms of processing personal data?

We guarantee we recognize all your rights under the General Data Protection Regulation: the right to access, rectify, and erase your data, restrict its processing, the right to transmit, not to be subject to automated individual decision-making, including profiling, and the right to object to the processing of your personal data.

You can exercise those rights when:

· - regarding data rectification: you notice that your data is incorrect or incomplete;

· - regarding data erasure: your personal data is no longer needed for the purposes for which it has been collected by the Company; you withdraw your consent to data processing; you object to the processing of your personal data; Your data is processed unlawfully; the personal data should be deleted in order to fulfil the obligation under the provision of law or personal data was collected when offering digital services to a child;

· - regarding data restriction: you notice that your data is incorrect - you can request restricting the processing of your personal data for a period that allows us to check if the data is correct; Your data is processed unlawfully, but you do not want it removed; We no longer need your data, but you may need it to defend or lodge a claim; or you object to the processing of your personal data - until it is determined whether the legitimate grounds on our part override the grounds for objection;

· - regarding data transmission: your personal data is being processed based on your consent or an agreement concluded with you and when this processing takes place automatically.

You have the right to lodge a complaint regarding the processing of your personal data by us to the supervisory body, which is the Inspector General for the Protection of Personal Data (address: Inspector General for the Protection of Personal Data, ul. Stawki 2, 00-193 Warsaw).

In what situations can you object against the processing of your personal data?

You can object against the processing of your personal data when:

· - the processing of your personal data is based on a legitimate interest or for statistical purposes, and the objection is justified because of a specific situation in which you have found yourself,

· - your personal data is processed for direct marketing purposes, including profiling for this purpose.


Remember, you can exercise your right to object starting May 25, 2018.

Where do we outsource your Personal Data?

If you leave your personal data under the content you are interested in, expressing the need to receive information about the offer - your personal data will be forwarded to Partners who will provide information about the product or service. You will be notified about the transfer.

Under personal data processing outsourcing agreements, your data can be found on websites that support management and communication, such as:

  • - Facebook
  • - Google
  • - Benhauer
  • - Smartsupp
  • - Smartlook

We may transfer your personal data to public authorities that fight against fraud and abuse.

How long do we store your Personal Data?

We store your personal data until you withdraw your consent, and after its termination for the purposes of:

· - pursuing claims related to the execution of the agreement,

  • - preventing fraud and abuse,
  • - statistical analysis and archiving.

We store your personal data for marketing purposes for the duration of the agreement or until you object to such processing, whichever occurs first.

If you are subscribed to our free newsletter, we will process your data until you decide to unsubscribe.

*Do we outsource your data to countries outside the European Economic Area?*

Your personal data will be outsourced outside the European Economic Area to Google LLC and Facebook, Inc. based on appropriate legal safeguards, which are standard contractual clauses for personal data protection, approved by the European Commission.

16. Complaints.

16.1. The User lodges complaints related to our Service to Get Ride within 30 days counting from the day of occurrence of the event being the basis for the complaint or from the date the User obtained information about this event. Complaints may be lodged in writing, by phone or using digital data carriers.

16.2. If the subject matter of the complaint cannot be properly determined from the contents, Get Ride will ask the User to provide an explanation or follow-up, with information that failure to remove these deficiencies will leave the complaint unresolved.

16.3. The complaint is handled within 14 days from the date of its receipt.

16.4. Get Ride shall notify the User about how to handle the complaint via e-mail.

17. Reserving the right to change.

17.1. Get Ride reserves the right to make changes to the content of the Terms and Conditions.

17.2. Changes made to the Terms and Conditions will be available to the User in writing in the form of notification provided to the User connected to Get Ride with a Cooperation Agreement by e-mail or by sharing the current content of the Terms and Conditions at www.getride.pl.

17.3. If the User does not accept the changes to the Terms and Conditions, he or she may terminate the Cooperation Agreement with immediate effect within 14 days of receiving the notification of the change. If within 14 days after sharing information about changes to the Terms and Conditions, the User fails to state his or her objections against their content, the new provisions become binding.

17.4. Using the Get Ride website requires the User to accept the terms and conditions.

18. Deduction, Assignment.

18.1. The User can make a deduction from the Price payable to Get Ride only if he or she has a claim established by a valid court decision against Get Ride. This also applies to the complaint procedure.

18.2. The User cannot transfer (assign) rights and obligations under the Cooperation Agreement or Order to third parties without the written consent of Get Ride.

19. Price List for Additional Services

19.1. Price for waiting for the User, excluding provisions that are included in the Terms and Conditions.

19.1.1. MTT – 2.63 PLN/min.

19.1.2. VGR – 3.52 PLN/min

19.1.3. BGR – 4.15 PLN/min

19.2. Mileage limit for Time Reservation is 20 km per a 30 minute period.

19.3. Fees for changing a car classification:

19.3.1. MTT for VGR: price for MTT x 1.1

19.3.2. MTT for BGR: price for MTT x 1.2

19.3.3. VGR for BGR: price for VGR x 1.1

19.4. Additional options described in section 4.4. of the Terms and Conditions are priced individually by Get Ride employees at +48 501 527 526

19.5. Payment reminder: 50 PLN

20. Loyalty program - "Ridding with Get Ride"

20.1. The "Ridding with Get Ride" loyalty program is organized by Get Ride. The loyalty program begins on 01/09/2014 and is available until further notice. The aim of the program is to reward Users by granting them points depending on the total for ordered services in Get Ride. Users who signed up at www.getride.pl can take part in the program.

20.2. The points are counted as follows: 10 PLN = 1 point.

20.3. Discounts for collected points:

20.3.1. From 1 to 100 points = 2% off the service price.

20.3.2. From 101 to 200 points = 5% off the service price.

20.3.3. From 201 to 300 points = 8% off the service price.

20.4. The User has no time limits to use the discounts he or she is entitled to.

20.5. The User can use any number of points gathered on his or her account and turn them into discounts.

20.6. "Ridding with Get Ride" cannot be combined with other discounts and special offers organized by Get Ride.

21. Final provisions.

21.1. All legal issues connecting the User and Get Ride are based on the law applicable in Poland.

21.2. In the event of any disputes, the decisive court is the competent court for the office of Get Ride.
